Terms & Conditions

These Terms & Conditions apply to all offers, agreements, and services provided by vandijksecurity in connection with its web‑based backup service. Use of the service constitutes acceptance of these terms.

In these terms, the following definitions apply:
Service: the web‑based backup service as described in the offer;
Customer: the natural or legal person using the Service;
Agreement: the written or electronic confirmation of the Customer’s purchase of the Service.

vandijksecurity provides the Service in accordance with the description in the offer and documentation. Maintenance, support, and updates are provided according to the agreed service levels.

The Customer is responsible for providing accurate and timely data, securely managing access credentials, and reporting any errors or security incidents.

Fees are agreed in writing in advance and exclude VAT. Payment is due within 30 days of invoice date, unless otherwise agreed. Late payment incurs statutory commercial interest without further notice of default.

vandijksecurity`s liability is limited to direct damage and shall not exceed the amount paid by the Customer for the Service in the preceding year. Consequential damage, business interruption, and loss of profit are excluded.

The Agreement is concluded for the period specified in the offer and is tacitly renewed for the same term. Termination must be in writing with at least one month’s notice before the end of the current term.

All intellectual property rights in the Service, documentation, and software remain with vandijksecurity or its licensors. The Customer is granted a non‑exclusive, non‑transferable right to use.

Personal data is processed solely within the context of the backup service in accordance with our Privacy Policy. Third‑party processing (e.g., AWS Cognito) acts only as a processor with no independent access to content.

vandijksecurity reserves the right to modify these Terms & Conditions. Changes will be published on our website and take effect upon publication.

These Terms & Conditions and the Agreement are governed by Dutch law. Disputes will be submitted to the competent court in The Netherlands.
